So here is my dilemma. I sell on Ebay to fund my European travels..well ok, just this one! So I take the pictures, start the ad and then lo and behold! Some bloke has the nerve to copy my ad AND steal my pics AND start his auction a day after mine. I emailed him to cease and desist. No reply. However if any of you have the time...would you mind emailing him to ask him if the photos are of his projector? Because you had read "somewhere" that the photos had been taken from another Ebay ad and if so, that would be a fraudulent ad. Yes, I know, I should let it go...but grrrrr! It took me a long time to photos, setup, etc.

Hi Alan

Maybe you could complain to Ebay authorities about this, as you would if it was a non-paying winning bidder. As long as you have the proof and you can confirm what you say. As for the rest of it, releasing any pictures to public domain comes with the risk. I do portfolios for models, and/or wedding photography. I make it very clear with today's times, that my clients should understand the risk when showing their pictures with the web.

You should report him to Ebay straight away.
He could well have no projector, and do a runner with someones money.

Alan, tell the bidders of the item it.

If you want prevent pic-stealing, put your member name in the pic. I think your software will allowe to do that.

The seller contacted me this morning, apologized and said that he will try and get the one bidder to retract his bid and when that happens he will close the auction.
He said that he didn't think I would get so upset since the condition of his machine was the same as mine! I asked him if his box was the same. He said no, his box was in better shape!!

Hi,

this has happened with my auctions very often, too. eBay could not give me any advice, because they can not check who has stolen the photos from whom and they do not give any law advices (eBay is telling this as soon as there are problems - they simply do not care). I have written in the items description on eBay that I do not allow to copy my photos and that anyone who ignores this, will be prosecuted. Maybe this will help.

If I were you I would accept this - there is no other way.

Ok. I understand that problem with stolen picīs. I have 3 Websites, one is about movie Serials, other one is a moviememorabilia shop and the last one is about self made drawings. Some people used pics from all of my websites. I was angry but....
I canīt understand what is the problem if a guy use photos from your projector, have you got problems to sell your projector? No, in this case I donīt understand your problem, you sell this item on photo and the other guy donīt have the same item. He is the one who have a problem.
Ok. Maybe you all see this problem different, but I thing it is not worth to make trouble.

The main problem is that if they were stock photos..meaning some in a catalog, there would be no problem. But these pictures were definitely shot at my house, therefore when the Ebay community sees that there are 2 items with the exact same picture they email me and ask me if I have another auction going. I tell them no and I get a link to the other auction. Also 2 Auctions with the exact same pics and text dilutes the field so to speak. So in essence we both will lose.

Hi, Alan, this has happened to me on three of my auctions(one person even used my item number in his ad as a reference that his item was a better price). I reported all three to ebay and ebay made the other sellers stop. Also, he does not have to ask the bidder to cancel the bid, he can cancel [Cool] the bid.

Next time you post an item in eBay, add the following script in your auction. Not 100% foolproof but it will certainly help.

I once sold a reel of Judy Garland trailers on ebay.

Nice little two hundred footer reel I had scanned a photo and stuck it on the box etc.

Sold to a UK collector. Imagine my surprise when I was scanning
overseas 8mm and see my little Judy Garland reel with some seller in Michigan.

I wrote to him and said he could keep the Judy Garland reel but could he give me back my dining room carpet that was under the box.

As an update, the seller took down his ad, apologized and that was that. I told him that I am not a dealer but an individual and that once my auction was over, he could use the pics. Why not? I don't have another one of that machine! [Smile]

Interesting side note is that the seller apologized and pulled the ad. Today I received an email from Ebay saying that they pulled the auction as well! So even if the seller refused to pull the ad Ebay will do it for you.
Hmm....Ebay is getting better in the customer service dept. it seems!

I've seen several pics from Phil Johnson's web-site used on EBAY as pics for the item being sold so I never bid on them. I check Phil's site regularly so I've come to memorize the graphics on it. I haven't seen any pc-lifting from site recently, though. I wonder if his copyright disclaimer gives him full protection from people being able to "borrow" any of the pics he uses.
